Probable Cause of Sex Discrimination Against Four Seasons Sunrooms of NY LLC and David Angosto

The Law Office of David H. Rosenberg P.C. filed a sex discrimination and retaliation complaint on behalf of a female employee (“Complainant”) with The New York State Division of Human Rights on January 17, 2022. The Respondents in that action, Four Seasons Sunrooms of NY LLC and David Angosto (“Respondents”), argued to the New York State Division the following:

1. Complainant’s attire was “not professional” and “inappropriate”;
2. Complainant “continued to have various work performance issues” including “her refusal to perform tasks that all other salespersons regularly perform, including properly filling out contracts, the scope of work and working with the production department”;
3. Complainant had been “failing to follow through on required paperwork and preparation” for reviews; and
4. Complainant had “been disrespectful and disinterested” which “was reflected by her making faces, inappropriate comments and not fully participating in meetings.”

However, The Law Office of David H. Rosenberg, P.C. argued vigorously that Complainant was treated less well on account of sex and the Division issued a probable cause determination in Complainant’s favor.
