NYSDHR Case No. 10222891
On or around December 30, 2022, the Law Office of David H. Rosenberg, P.C. (“Firm”) filed a Verified Complaint of race, color, and sex discrimination against the DOC on behalf of Complainant, a white male corrections officer, with the New York State Division of Human Rights (“NYSDHR”).
In response, the DOC strenuously argued that Complainant was neither discriminated against nor retaliated for and the main alleged harasser, York, even argued to the NYSDHR that Complainant “hung a noose in the bathroom” for him to see. York told the NYSDHR that it was he, not Complainant, who was the real “victim of retaliation by DOC.”
However, due to the vigorous prosecutorial efforts of the Firm, the NYSDHR disagreed with Respondents and found in Complainant’s favor, anyway.
On August 22, 2024, the NYSDHR issued a PROBABLE CAUSE determination in Complainant’s favor stating that “PROBABLE CAUSE exists to believe that the Respondents have engaged in or are engaging in the unlawful discriminatory practice complained of.”
The NYSDHR agreed with the Firm in that the allegations within the Verified Complaint justified “a review during an administrative hearing” and that the “proximity of Complainant’s protected activity to his subsequent transfer warrants finding that Complainant may have been penalized for his internal complaint.”
