Re: Probable cause against PROMOTIOANAL DEVELOPMENT Inc. and Dorothy Sylvester/national origin discrimination and retaliation
On March 11, 2020, The Law Office of David H. Rosenberg, P.C. filed the aforementioned administrative action with The New York State Division of Human Rights (“NYSDHR”) on behalf of a disabled Haitian employee (“Complainant”) against Promotional Development Inc. (“PDI”), and controller/director of human resources, Dorothy Sylvester (“Sylvester” and all together as “Respondents”), for unlawful discriminatory practices relating to employment because of national origin, disability, and retaliation for opposition to said practices of N.Y. Exec. Law, art. 15 (“Human Rights Law”).
On August 17, 2020, PDI argued to the NYSDHR that Complainant was a poor performer who deserved to be terminated. Specifically, PDI wrote:
However, due to the vigorous prosecution of these discrimination and retaliation claims by David H. Rosenberg Esq., Complainant was able to show that the offered excuses were a pretext and achieved a PROBABLE CAUSE determination in Complainant’s favor against Respondents from the NYSDHR.
