On February 29, 2024, The Law Office of David H. Rosenberg, P.C. (“Firm”) filed a verified complaint of sexual harassment and retaliation with The New York State Division of Human Rights (“NYSDHR”) on behalf of the Firm’s male client (“Complainant”), a former employee.
As alleged in the verified complaint, Ali texted Complainant, “u made me mad horny”; “u cut?”; and “u gonna shower before you come or at the hotel?” Complainant opposed the treatment by not responding directly and trying to change the topic of conversation.
At the holiday party, Ali said to Complainant generally, “Are you staying at the Marriott as well? I have a room there; do you want to come by my room for more drinks?” Complainant opposed the treatment by saying no and, “I will be with my wife tonight.”
The next day, Ali said to Complainant, “Good morning, where were you last night?” Complainant opposed the treatment by responding with “I was in my room asleep” and then tried to change the topic of conversation.
On January 5, 2024, Ali grinned at Complainant and said, “I was instructed to let you go, I tried to help you out but as of now you’re terminated.” Other non-male employees, and those who did not oppose discriminatory practices, were not treated this way.
