On July 11, 2022, The Law Office of David H. Rosenberg, P.C. (“Firm”) filed a verified complaint of age discrimination and retaliation against Clear Street Management (“Company”), Grant Burton (“Burton”), Matthew Marino (“Marino”), and Amanda Bond (“Bond”).
The Firm’s client was born in the year 1997 (“Complainant”) and alleged that on his first day of work, Marino said, “Now listen, you are young, you just graduated from college.” Complainant was uncomfortable, embarrassed, and ashamed by the comments about his younger age from his manager on the first day of work; and tried to change the topic of conversation.
As alleged in the verified complaint, Burton said to Complainant: “Ok, wow, you are so young, when did you graduate?” and “Wow, ok, so you are young, you must be on TikTok, what do you do on TikTok” in front of male client partner specialist Giuseppe Speranza (“Speranza”). Complainant tried to change the topic of conversation and Burton kept asking Complainant what he did on TikTok.
As alleged in the verified complaint, Burton said to Complainant words to the effect of, “You’re young, how often do you go live on TikTok?” in front of Speranza. Burton kept asking Complainant how often he went live on TikTok, and Complainant relented by responding with, “Depends, not so much since I started working here.”
As alleged in the verified complaint, Burton said to Complainant in front of Speranza words to the effect of, “There are a lot of young people on TikTok, I think that it’s cool that you do it.” Complainant, who maintained a TikTok account, was uncomfortable, embarrassed, and ashamed and tried to change the topic of conversation. However, Burton kept telling Complainant how “cool” it was that he went live on TikTok, and Complainant relented by responding with, “Thank you.”
As alleged in the verified complaint, Burton said to Complainant in front of Speranza, “You’re doing great, you are young, this is your first job, you’re doing a great job”; “You are still young, you are still learning”; “TikTok is for kids, I still think that it’s cool that you do it.” Complainant was uncomfortable, embarrassed, and ashamed by the comments about his younger age, and tried to change the topic of conversation. However, Burton kept telling Complainant how he, Burton, thought it was “still cool” that Complainant went live on TikTok, and Complainant relented by responding with, “Thank you.”
As alleged in the verified complaint, Bond asked Complainant, “When did you graduate” and said, “Ok, yeah, see, you are young. You are like a baby to us.” Other older employees and those who did not oppose discriminatory practices were not treated this way. In front of Speranza, Burton, and female client partner Beatrice Guerrier (“Guerrier”), Bond said words to the effect of, “I heard you are on TikTok, what is your username.”
As alleged in the verified complaint, Bond was laughing when she put her hand on Complainant’s arm and shoulder. Complainant moved away from Bond’s unwanted physical touch. Bond later said to Complainant in front of Guerrier, Speranza, and Burton, generally “What is your TikTok, what’s your username, or is it a secret?” Complainant tried to change the topic of conversation. However, Bond kept asking Complainant for his TikTok username and Complainant relented by responding generally, “I do not want to share that information with you.” Other, older employees and those who did not oppose discriminatory practices were not treated this way.
As alleged in the verified complaint, Bond said to Complainant generally “Do you know this TikTok trend, you are young and on TikTok”; “We must seem like a prehistoric age to you”; “You are only 25 years old.” Complainant admitted that he was to which Bond responded, “Well, we must be colossal age to you.”
On June 27, 2022, Marino terminated Complainant on account of age and in retaliation. When asked for a reason for his termination, Marino responded, “It’s just not working out.” Other, older employees and those who did not oppose discriminatory practices were not treated this way. After termination, Burton told Complainant in a phone call, “I can get away with it because I’m like 10 years older than you.”
